The Schuetz Parkland is to our east and covered by our boundary agreement with the Town of Dunn. The Town of Dunn has pledged $10,000.00 toward McFarland’s purchase of it.
Below is an excerpt from the relevant portion of the boundary agreement between McFarland and the Town of Dunn.
Section 2 of the Agreement is “Restrictions on Town Purchase of Conservation Easement”, and states:
The Town agrees not to purchase conservation easement pursuant to the Town of Dunn Rural Preservation Program...in the Village’s planned Eastside Growth Area”
Section 4 of the Agreement is “Town Not To Oppose Annexations” and states:
“...the Town agrees not to oppose annexations of territory to the Village located...within the Village’s planned Eastside Growth Area.”
Dunn can’t protect the land in any way; they have waived any control over it. McFarland can protect it only by buying it for parkland. If we don’t, the Schuetz family will sell to the highest bidder. Dunn can’t stop that sale.
That new owner will petition McFarland for annexation. Since it’s in the territory belonging to McFarland under the boundary agreement, there would be no reason to deny annexation, and Dunn can’t stop it.
Following annexation, the waters get muddier. It is currently zoned parkland, so the zoning would have to be changed. Chris Klar says that wouldn’t happen, but recent requests for such zoning changes were defeated by only a very slim margin. Who can say that a future Board wouldn’t think that the taxes generated by half-acre estates are too good to pass up?
If such a zoning change came before the current Board majority, there can be little doubt that it would pass.
